OVERVIEW Welcome to AnalíaCosmetics! The terms “we”, “us” and “our” refer to AnalíaCosmetics. AnalíaCosmetics operates this store and website. Our Services are powered by Shopify. By using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

SECTION 1 - ACCESS AND ACCOUNT By agreeing to these Terms, you represent that you are at least the age of majority in your country of residence (18 years in Malta). You are responsible for maintaining the security of your account credentials.

SECTION 2 - PRODUCTS AND ACCURACY We make every effort to display the colors and images of our cosmetics accurately. However, we cannot guarantee that your monitor's display will be accurate. Descriptions and pricing are subject to change without notice.

SECTION 3 - ORDERS AND CONTRACT Your order is an offer to purchase. A contract is only formed when we send you a shipping confirmation. We reserve the right to refuse any order. You confirm that purchases are for personal use and not for resale.

SECTION 4 - PRICES AND BILLING Prices include VAT where applicable but exclude shipping costs unless stated. You agree to provide current, complete, and accurate purchase and account information.

SECTION 5 - SHIPPING AND RISK Delivery times are estimates. In accordance with EU law, the risk of loss or damage passes to you when you (or a third party indicated by you) take physical possession of the goods.

SECTION 6 - RIGHT OF WITHDRAWAL AND RETURNS Your purchases are subject to your statutory right to cancel within 14 days as detailed in our Refund Policy. Note that for hygiene reasons, sealed cosmetic products that have been unsealed after delivery are exempt from the right of withdrawal.

SECTION 7 - INTELLECTUAL PROPERTY All content included in the Services (text, graphics, logos) is the property of AnalíaCosmetics or its licensors and is protected by copyright and trademark laws.

SECTION 8 - LIMITATION OF LIABILITY Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, or for fraud. In all other cases, our liability is limited to the amount paid for the products purchased.

SECTION 9 - GUARANTEES As a consumer in the EU, you benefit from a legal guarantee of conformity for goods. This means we are liable for any lack of conformity that becomes apparent within two years of delivery, subject to the conditions of the Consumer Affairs Act (Chapter 378 of the Laws of Malta).

SECTION 10 - GOVERNING LAW AND JURISDICTION These Terms of Service and any separate agreements shall be governed by and construed in accordance with the Laws of Malta. Any disputes shall be subject to the non-exclusive jurisdiction of the Courts of Malta.
